Legal contributor Attorney Brian Mickelsen, an experienced truck accident lawyer, represents victims injured or killed in box truck and 18-wheeler accidents. Below, Attorney Mickelsen shared his insight into the legal options available to victims injured in commercial truck accidents.
“Trucking accidents are on the rise. As more trucks hit the roadways, more and more families are being affected by negligence in the trucking industry. And because of their size, tractor-trailers, semi-trucks, 18-wheelers, and commercial vehicles oftentimes cause catastrophic damage, injuries and death. Commercial trucking companies must ensure that their vehicles and drivers are obeying all trucking laws. If they fail to do so, they can be found liable for injuries or deaths caused to those around them.”
Approximately 500,000 trucking accidents occur each year in the United States, with about 5,000 per year resulting in death. Roughly 68 percent of all fatal truck accidents happened not in cities, but in rural regions.
“In the wake of such a catastrophic event, it is critically important that key evidence is not lost or destroyed – including, witness testimony, dash and body cam footage from responding officers, dash cam from the truck involved, hours of service logs for the at-fault truck driver, electronic black box data from all vehicles involved, vehicle inspections from the at-fault truck, toxicology reports, etc.”
